By accessing or using the Instinct platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Instinct is an AI-powered sales coaching platform that integrates with Granola.ai to analyze your sales conversations and provide personalized coaching insights, skill tracking, and improvement recommendations.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information during registration.

4. Subscriptions and Billing

• Instinct offers free and paid subscription plans. Paid plans are billed monthly or annually through our payment provider, Polar.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Share your account credentials with unauthorized third parties.
• Upload or transmit malicious code or content through the Service.

6. Intellectual Property

The Service, including its design, features, and content, is owned by Instinct and protected by intellectual property laws. You retain ownership of your sales call data and any content you provide through the Service.

By using the Service, you grant us a limited license to process your data solely for the purpose of providing coaching insights and improving our AI models.

7. AI-Generated Content

The coaching insights, recommendations, and analyses provided by Instinct are generated by AI and are for informational purposes only. They do not constitute professional advice. You are responsible for any decisions made based on these insights.

8. Third-Party Integrations

The Service integrates with third-party services such as Granola.ai. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability or functionality of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, Instinct shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service. Your continued use after changes constitutes acceptance.
